What is the justification for the sex abuse lawsuits against Catholic dioceses?

If a priest in known to be guilty then why punish the whole diocese with a lawsuit? If there was a coverup then punish those involved. If a kid is molested at a public school, can you sue the school district?


If an individual is guilty of a crime and it is clear that his institution played no part in the crime, then obviously the institution cannot be sued. But many crimes of this sort are judged as 'institutional' crimes, where it is believed that the institution somehow made the crime possible, by facilitating it, if only by negligence. If authorities knew about the crime and did nothing to prevent it, or ignored reports of it, then the institution can be judged as guilty. Yes, this is true of public schools as well - a whole district can be sued if it is guilty of negligence regarding the crime of a teacher. In many cases, a Catholic diocese is structured legally as a 'corporation sole' with the bishop as the personal legally responsible for all of its property, etc. So the bishop can be sued and his whole diocese (including all parish property) can become liable.

Should Catholic Dioceses be allowed to avoid sex abuse trials by declaring bankruptcy?

Yet another diocese has applied for bankruptcy in order to delay sex abuse trials--this seems to be a fairly standard tactic.

Should the Church be ethically, morally or legally permitted to avoid their responsibility this way?

Rest assured that if many more bankruptcy moves are made . .the government will step in and just claim the properties and sell them to cover the cost for victims and the court systems that have to bear the cost of this ridiculous activity.

In these hard financial times, every government is looking to save big dollars . .and endless legal cases the state has to do will be in the frame .
